OFFICIAL MEGA CONSERVATION EDUCATION RAFFLE RULES
BY PURCHASING A TICKET AND ENTERING INTO THIS MEGA CONSERVATION EDUCATION RAFFLE (THIS “RAFFLE”), YOU AGREE TO BE BOUND BY THESE OFFICIAL RAFFLE RULES (THE “OFFICIAL RULES”), WHICH ARE A BINDING CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, THE OFFICIAL RULES INCLUDE CERTAIN RELEASES FROM YOU AND A LIMITATION OF YOUR RIGHTS AND REMEDIES, INCLUDING A WAIVER OF YOUR RIGHT TO A TRIAL BY JURY. THIS RAFFLE IS VOID WHERE PROHIBITED BY LAW OR REGULATIONS.
REGISTRATION WITH THE STATE OF SOUTH CAROLINA
The South Carolina Waterfowl Association (SCWA) was established as a 501(c)(3) nonprofit organization on December 16, 1986. SCWA exists to enhance and perpetuate our wildlife heritage through education and wildlife habitat conservation. As part of this mission SCWA operates at 1,237-acre Wildlife Education Center with over 8,000 youth and several thousand adults who participate in wildlife conservation education programs on an annual basis. This raffle is registered with the South Carolina Secretary of State office.
ELIGIBILITY
This Raffle is only open to individuals who satisfy each of the following requirements (each an “Eligible Individual“): (i) must be an individual who is a legal resident of the United States and who is a legal resident of a state where this Raffle is not void or prohibited; (ii) must be at least the age of majority in his or her State of residence at the time of entering this Raffle; (iii) must not be a SCWA employee, officer, director, nor an immediate family member of any of the foregoing; (iv) must not be an individual providing a prize or any member of the immediate family thereof, (v) must not be an employee, officer, director, agent, nor an immediate family member of any of the foregoing, of any entity providing a Prize; and (vi) must not be a person restricted from participating in the Raffle pursuant to South Carolina code of laws Title 33, Chapter 57. For the purposes of this section, “immediate family” means a spouse, child, step-child, brother, sister, son-in-law, daughter-in-law, parent or grandparent. Residents of Alabama, California, Hawaii, Kansas, New Jersey, Utah, and Washington are not eligible to win a Mega Conservation Education Raffle prize according to their state’s current law.
RAFFLE ENTRY START AND END DATES / HOW TO ENTER:
The entry period (the “Entry Period“) for entering this Raffle starts on March 15, 2023 and continues through 11:59 pm Eastern Standard Time on May 15, 2023. Tickets will not be sold after 11:59 pm Eastern Standard Time, May 15, 2023.
Eligible Individuals may enter this Raffle by purchasing tickets online at MegaConservationEducationRaffle.Org during the Entry Period (each an “Entry” and collectively the “Eligible Entries“). Tickets are $20.00 each, 3 for $50, or 10 for $100. Ticket purchases can be made by Visa, MasterCard, Discover, or American Express. Mail in orders are not accepted. Eligible Individuals may buy as many tickets as they wish. All sales transactions are final. No payments will be refunded unless this Raffle is canceled. Every Eligible Entry will be assigned a unique identification number, and a raffle ticket number representing such Eligible Entry will be emailed to such Eligible Individual confirming the Entry, at the email address submitted with the Entry. You will receive your ticket number(s) at the completion of checkout and in your confirmation email. If you do not receive a confirmation email, please be sure to check your SPAM/JUNK MAIL FOLDERS.
Only one Eligible Individual may be entered into the Raffle for each Entry (i.e., for each ticket) sold. In other words, only one name, one method of payment, and one e-mail address are permitted per Entry. If the name of more than one person is submitted with an Entry, and that ticket is selected as a winning ticket, then the person named first will be deemed the holder of record of that ticket. Division of any Prize by a group purchasing a ticket in common shall be the sole responsibility of the person named as or deemed the holder of record of that ticket, should that ticket be selected as a winner.
By submitting an Entry into this Raffle, each Eligible Individual fully and unconditionally agrees to be bound by these Official Rules and the decisions of SCWA and its appointed agents, which will be final and binding in all matters relating to this Raffle. SCWA is not responsible for incorrect or inaccurate capture of Entry information, technical malfunctions, lost or delayed data, any interrupted or unavailable network server or other connections or communications, any failed computer transmissions, software or hardware malfunctions, interruptions, defects, or failures, or any errors, omissions, interruptions or deletions of any kind due to electronic, human, mechanical, printing, production or technical errors or other causes, or for any damage to a person’s computer. Any late, incomplete, invalid, unintelligible, or illegible entries will be disqualified.
Each Entry submitted in violation of these Official Rules will be void. SCWA reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with this Raffle process or to be acting in violation of these Official Rules or in a disruptive manner.
The IRS has taken the position that amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not gifts, and consequently, do not qualify as deductible charitable contributions.
RANDOM DRAWING / NOTIFICATION
Thirty (30) potential winners (each a “Potential Winner“) from the Eligible Entries received during the Entry Period will be randomly selected in an electronic drawing (the “Drawing“) conducted by SCWA staff on May 16, 2023 at SCWA Headquarters 9833 Old River Road, Pinewood, South Carolina. SCWA Executive staff will be present to observe the Drawing. Odds of winning depend on the total number of Eligible Entries received during the Entry Period.
Within five (5) days following the Drawing, SCWA will attempt to contact each of the first Thirty (30) Potential Winners selected in the Drawing (each a “Top Thirty Winner” and collectively the “Top Thirty Winners“) by phone or email using the contact information listed in such Top Thirty Winner’s Entry form (the “Notification“). Within seven (7) days of the Notification, each Top Thirty Winner will be required to provide SCWA with each of the following (collectively the “Paperwork“):
(i) a copy of a valid driver’s license or other valid identification issued to the Top Thirty Winner, evidencing that the Top Thirty Winner is at least the age of majority as of the date of entry into this Raffle;
(ii) an Affidavit of Eligibility and Liability/Publicity Release, in such form as is provided by SCWA, fully signed by the Top Thirty Winner, attesting to such Potential Winner’s eligibility and compliance with the Official Rules; and
(iii) a fully completed and signed W-9 tax form.
If any Top Thirty Winner: (i) fails to respond to the Notification, or is unable to be contacted by SCWA using the information provided in his or her Entry (or the Notification is returned undeliverable), within seven (7) days after SCWA attempts such Notification; or (ii) declines to accept his or her Prize, or fails to select a Prize; or (iii) fails to return the properly completed Paperwork within the time designated by SCWA or (iv) is found to be ineligible pursuant to, or fails to meet the requirements of, these Official Rules; or (v) does not comply with these Official Rules; or (vi) is ineligible to receive the Prize he or she selected; or (vii) fails to pick up his or her Prize within the allotted time set forth by SCWA, such Top Thirty Winner and his or her Entry will be disqualified and another Top Thirty Winner will be randomly selected from the remaining Eligible Entries received.
The Top Thirty Winners will be posted on the Mega Conservation Education Raffle Web Site on May 31, 2023.
PRIZES
Subject to these Official Rules, only the prizes set forth below will be awarded in connection with this Raffle (each a “Prize” and collectively the “Prizes“).
The list of Prizes which are only eligible for the Top Thirty Winners, such Prizes being allocated in accordance with the Prize Selection Procedures (as defined below), are as follows (each a “Top Thirty Prize” and collectively the “Top Thirty Prizes“):
- 2023 Ram 1500 Crew Cab 4×4 Built to Serve Edition Truck – Retail Value $65,065
Winner will pick up the 2023 Ram 1500 Crew Cab 4×4 Built to Serve Edition truck from Spartanburg Chrysler Dodge Jeep Ram located at 8200 Fairforest Road, Spartanburg, South Carolina 29303 no later than June 9, 2023. All applicable state sales tax, registration, and titling fee in their state of residence is not included and is the sole responsibility of the applicable Top Thirty Winner.
2. Bentley Pontoons 2023 – Fish 223 Fish-N-Cruise powered by a DF 140 B Suzuki Outboard Motor – Retail Value $54,932
Winner will pick up the Bentley Pontoons – Fish 223 Fish-N-Cruise powered by a DF 140 B Suzuki Outboard Motor at a South Carolina Bentley Pontoons boat dealer no later than June 9, 2023. The trailer for the boat is not included. All applicable state sales tax, registration, and titling fee in their state of residence is not included and is the sole responsibility of the applicable Top Thirty Winner.
3. 2022 Harley-Davidson Pan America™ 1250 Special (G.I. Enthusiast Collection) motorcycle – Retail Value $24,688
Winner will pick up the 2022 Harley-Davidson Pan America 1250 Special (G.I. Enthusiast Collection) motorcycle at Harley-Davidson of Greenville South Carolina no later than June 9, 2023. All applicable state sales tax, registration, and titling fee in their state of residence is not included and is the sole responsibility of the applicable Top Thirty Winner.
4. New Zealand Big Game Hunt and Tour – 2 Hunters and 2 Non-hunters (2 couples) – 8 Days – Retail Value $25,400
This hunt is provided by Scott Thomson’s Red Stag Hunting New Zealand. The hunt includes four days of Red Stag hunting and 4 days of touring. Includes trophy fees for two red stags up to 400 inches SCI. You can book extra hunters and extra days to hunt Fallow deer, Tahr and Chamois at the regular rate. Hunt includes transportation to and from the closest New Zealand airport to hunting location, breakfast, lunch, snacks and dinner, beer, wine and drinks, lodging, guide, use of firearm, field preparation of your trophies, trophy fees for two stags up to 400 inches SCI and free wifi at the lodge. This hunt cannot be taken in conjunction with any other New Zealand donations or outfitted hunts. Hunt can only be taken in 2023 or 2024 subject to available dates. 5. South African Plains Game Hunt, 4 People, 5 Days – Retail Value $11,600
This hunt is provided by Wild Wildebeest Safaris, Tony du Bruyn Outfitter. Four of you will be hunting private ranches for a large variety of plains game. Hunt includes deluxe lodging at a premier lodge with en-suite bathrooms, five-star meals, beverages, daily laundry service, and one professional hunter for every 2 hunters. Hunt includes trophy fees for one trophy Gemsbuck for a total of 4 animals. Hunters can upgrade the hunt to up to 10 days for $220 per person per additional day. Hunters can shoot a large variety of plains game including Kudu, wildebeest, and many other species for additional trophy fees. Airfare to and from Johannesburg and Sishen (Northern Cape), tips, dip and packing fees, and gun and hunting licenses are not included. 7. Rack and Reel Montana Elk and Mule Deer Hunt – 1 Person 5 Days – Retail Value $9,500
This hunt is provided by Rack and Reel Outfitters. The hunt is a Deer and Elk Combination hunt during the 2024 September archery or November rifle season, 6 nights, 5 days, all-inclusive hunt on private land. Lodging is in a 6-bedroom lodge, private in-house chef provides 3 meals per day, fully stocked bar, airport shuttles to and from Bozeman, Montana. We provide taxidermy and meat processing drop off and shipping services, and apply for all tags and licenses for you. NOT included is gratuity, taxidermy/meat processing fees, shipping, and license/tag fees. Airfare to Bozeman, Montana is not included. Raffle winner must contact the outfitter before September 2023 to book dates for 2024 September Archery or November Rifle season. Exact dates are subject to availability. Options to bring additional hunters are available in the archery season only. Up to 1 non-hunting guest may accompany a rifle hunter for an additional fee. 8. Jarrett Legendary Beanfield Rifle – 300 Win Mag – Retail Value $8,000
This Original Beanfield rifle is built on a Remington 700 action that has been trued. The barrel is a proprietary barrel manufactured completely in house and hand lapped to achieve 1/10th of a thousandth deviation breach to muzzle. A Trigger Tech trigger is installed on the action. The barreled action is mated to a proprietary fiberglass stock. This rifle is chambered in .300 Winchester Magnum. The winner of this rifle will make arrangements to pick up the rifle from Jarrett Rifles. Any costs and fees associated with sales taxes and delivery of the Jarrett Legendary Beanfield rifle is not included and shall be at the sole cost and responsibility of the applicable Top Thirty Winner.
9. Wyboo Custom Gunworks Rifle with Zeiss Conquest V4 6-24×50 Scope – Retail Value $7,500
This Wyboo Custom Gunworks Rifle is a 6.5 PRC built on a Remington 700 action, with a McGowen 26” 1:7 twist octagon barrel. Special features include: Custom McMillan stock colored in “Woodland Carbon Ambush”, Flat face Triggertech trigger tuned to 1.5lbs, Zeiss Conquest V4 6-24×50 Scope and Hawkins ultralight scope rings mounted on a Talley MOA base. The winner of this rifle will make arrangements to pick up the rifle from Wyboo Custom Gunworks. 10. Saskatchewan Spring Snow Goose Hunt – 2 People, 3 Days – Retail Value $7,000
This hunt is provided by Duck Creek Outfitters. The hunt includes a two person three day four-night Spring conservation snow goose hunt in Eastern Central Saskatchewan. The hunt includes shotgun shells, bird cleaning, transportation to and from the field and all meals and lodging. The hunt includes three morning hunts and two afternoon hunts. Hunt is good for the 2024 Spring Snow goose (April, May 2024) season only. Exact dates subject to availability. This hunt will have the availability to add two hunters to the group at the normal rate. This prize includes a one time limited right to transfer to another person.
11. Alberta Duck and Goose Hunt – 2 People 3 Days – Retail Value $7,000
This hunt is provided by Prairie Waterfowl Company. Hunt includes 3 morning hunts and 2 afternoon hunts. Afternoon hunts will not take place if daily bag limits are harvested during the morning hunt. The hunt includes excellent food, accommodations, and bird cleaning. Ammunition, gun rental, liquor and gratuity are not included. Winners are responsible for their own airfare and transportation to and from the airport to the outfitter. Hunt is good for Thursday September 5 to Saturday September 7, 2024 only. Extra hunters can book at the regular rate subject to availability. This prize includes a one time limited right to transfer to another person.
12. South Carolina Whitetail Deer/Hog Hunt – 6 Person, 2 Days – Retail Value $6,000
This hunt is provided by the South Carolina Waterfowl Association. Six of you will arrive at the South Carolina Waterfowl Association SCWA Wildlife Education Center at 2 p.m. on Friday, October 27, 2023. You will enjoy an afternoon deer hunt, Saturday morning and afternoon deer hunt and Sunday morning deer hunt. All meals, beverages, lodging and guides included. Transportation is not included. Hunt is good for October 27 – October 29, 2023 only. This prize includes a one time limited right to transfer to another person.
13. Casa Carolina Manuel Antonio, Costa Rica House Rental – Retail Value $5,000
Casa Carolina is providing a one-week house rental good for August 5 – August 12, 2023 only. There are 3 bedrooms in the main house and one bedroom in the luxury above garage suite. Each bedroom has its own full bathroom/shower. The Primary Suite has a King bed and its own private balcony overlooking the ocean. The Ocean View Suite has two Queen beds and the doors open to the upper deck. The Jungle View Suite has two Queen beds and overlooks the garden. The South Carolina Waterfowl Association is providing this hunt. Hunt Includes two days of guided duck hunting for three people in Clarendon County, South Carolina. Includes, lodging, meals, beverages, open bar, and bird cleaning. Transportation and tips are not included. The hunt good for January 18-20, 2024 only. This prize includes a one time limited right to transfer to another person.
18. South Dakota Prairie Dog Hunt – 2 People for 2 Days, 3 Nights – Retail Value $2,800
This hunt is provided by Dakota Prairie Lodge and Resort. The hunt includes two days of prairie dog hunting for two people. Includes luxury accommodations, three meals per day, an open bar, comfortable shooting benches, gun rests, field transportation, targets for sighting in rifles, and opportunities for evening coyote calling or sporting clays. Extra days or additional hunters can be booked at the regular rate. The hunt is good for 2023 only and is subject to available dates. 19. Argentina Blackbuck Hunt – 1 Person, 3 Days – $2,800
This hunt is provided by Argentina Wildwings. The hunt includes three days of Black Buck hunting for one person, deluxe accommodations, gourmet meals, snacks, an open bar with local beer, wine, and liquors, field preparation of trophy, and a trophy fee for one Blackbuck. Not included: Tips, hunting license (approximately $350), gun rental with ammo ($50/day), transfers from airport to lodge ($230 per person round trip), international airfare, transportation fees for trophy and items of a personal nature. Hunt can be upgraded to include additional hunters, fishing and additional big game species. Hunt must be taken from Mid-January – Early March 2024 only and is subject to available dates. 20. Costa Rica – Bahia Rica Fishing Trip – 2 People 3 Days – Retail Value $2,700
This fishing trip is provided by Bahia Rica. The fishing trip includes two days of fishing for sailfish, blue marlin, mahi and roosterfish. Includes all meals and beverages (non-alcoholic), 1 day of inshore fishing, 1 day of offshore fishing and 3 nights lodging at beautiful Bahia Rica lodge on the Pacific Coast of Costa Rica. Up to 3 additional people can fish each day for an additional fee of $50 per person per day. You will depart from Buck Hall Landing, 999 Buckhall Landing Rd, McClellanville, SC 29458. 30. Southeastern Wildlife Exposition (SEWE) Benefactor Soiree Package and 3-nights at hotel downtown Charleston for SEWE February 16 – 18, 2024. Retail Value $1,500
The Southeastern Wildlife Exposition Benefactor Soiree packages includes 3 nights lodging in a downtown Charleston hotel, two event access badges, two SEWE Soiree Tickets (Saturday, Feb. 18th), private preview hours, reserved seating at all Gaillard Center presentations, access to VIP lounges at Brittlebank Park, Charleston Marriott, Charleston Place and Gaillard Center, Priority Entry, VIP shuttle access and a signed 2024 SEWE artist of the year poster. PRIZE SELECTION PROCEDURES –
Within seven (7) days of the Notification, each Top Thirty Winner will be required to provide SCWA with a list (each a “Preference List”) ranking each of the Top Thirty Prizes according to his or her preference from most to least desirable. Subject to the requirements and qualifications of Top Thirty Winners set forth in these Official Rules, upon receiving the Preference Lists SCWA will allocate the Top Thirty Prizes in accordance with the following procedures (the “Prize Selection Procedures”):
The first Top Thirty Winner selected in the Drawing from the Eligible Entries will be allocated his or her top choice from his or her Preference List. Once the choice has been made, it cannot be changed.

CLAIMING PRIZES
Upon SCWA verification of: (i) the Top Thirty Winner’s eligibility and compliance with these Official Rules; and (ii) verification of receipt of the properly completed Paperwork by the Top Thirty Winner within the allocated time frame, SCWA will coordinate to make available the applicable Top Thirty Prize; provided, however, that SCWA, in its sole discretion, shall make the final determination of the pickup date and location of each Prize.
TAXES
SCWA will issue a 1099-Misc for Prizes, to the extent required by applicable law. Each Potential Winner is responsible for any payment of all local, state and federal taxes resulting from the income attributable to the receipt of any Prize, and should consult his or her professional legal and accounting advisors regarding the tax effects of his or her respective Prize(s). It is the responsibility of each Potential Winner to determine, to his or her satisfaction, the value of his or her respective Prize(s), and the tax effect and liabilities associated with each of them, in light of his or her personal financial circumstances.
DISPUTES
These Official Rules shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to conflicts of law principles. Any legal suit, action or proceeding arising out of or related to the Raffle, any Prize awarded or used in connection with this Raffle, or these Official Rules, shall be brought in and each participant in this Raffle, including each Potential Winner, irrevocably submits himself or herself to the exclusive jurisdiction of the state and federal courts of the State of South Carolina sitting in Columbia, South Carolina (Richland County, South Carolina), and irrevocably agrees that all claims in respect of such action or proceeding shall be heard and determined only in and by either of the state or federal courts sitting within Richland County, South Carolina. Furthermore, by participating in this Raffle, each such individual participating in this Raffle, including each Potential Winner, hereby irrevocably waives and agrees not to assert by way of motion, as a defense or otherwise in any such action or proceeding, any claim that such party is not personally subject to the jurisdiction of the state or federal court sitting in Richland County, South Carolina, that such action or proceeding is brought in an inconvenient forum, that the venue of such action or proceeding is improper or that these Official Rules may not be enforced in or by such state or federal court sitting in Richland County, South Carolina. EACH INDIVIDUAL PARTICIPATING IN THIS RAFFLE, INCLUDING EACH POTENTIAL WINNER, HEREBY WAIVES ANY RIGHT HE OR SHE MAY HAVE TO A JURY TRIAL ARISING FROM ANY DISPUTES RELATED IN ANY WAY TO THESE OFFICIAL RULES, THIS RAFFLE, OR ANY PRIZE.
LIMITATION OF LIABILITY; INDEMNIFICATION AND WAIVER; CLASS-ACTION WAIVER
By participating in this Raffle, to the maximum extent permitted by applicable law, each individual participating in this Raffle, including each Potential Winner, hereby releases, discharges, and agrees to indemnify and hold harmless SCWA, each Prize provider, and each of their respective officers, directors, members, managers, employees, representatives, and agents from and against any and all actions, claims, losses, damages, expenses, injuries, and loss of life to any persons or property that are caused by, arising from, or are related to, directly or indirectly, the operation of or participation in this Raffle or the receipt, acceptance, possession, misuse, or use of any Prize.
By participating in this Raffle, to the maximum extent permitted by applicable law, each individual participating in this Raffle, including each Potential Winner, agrees that any and all claims, actions, demands, and causes of action (collectively “Claims“) arising out of or in any way relating to this Raffle, these Official Rules, or any Prize shall be made individually, and not as a member of a class or otherwise in any form of class action.
By participating in this Raffle, to the maximum extent permitted by applicable law, each individual participating in this Raffle, including each Potential Winner, on behalf of himself or herself, and his or her heirs, executors, administrators, successors and assigns, hereby agrees that any and all Claims, judgments, and awards arising out of or in any way relating to this Raffle, these Official Rules, or the use or misuse of any Prize shall be limited to only the actual out-of-pocket costs incurred with entering this Raffle, and in no event may any attorneys’ fees be claimed, included, or awarded.
SCWA SHALL NOT BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO THIS RAFFLE OR ANY PRIZE. SCWA’S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THIS RAFFLE SHALL NOT EXCEED THE FUNDS RECEIVED FROM TICKET SALES IN CONNECTION WITH THIS RAFFLE.
EACH PRIZE PROVIDED IN CONNECTION WITH THIS RAFFLE IS PROVIDED “AS IS WHERE IS” AND SCWA MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTY AS TO MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WHETHER ARISING BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE, OR OTHERWISE, EACH OF WHICH ARE EXPRESSLY DISCLAIMED.
PUBLICITY WAIVER
By entering this Raffle, each Eligible Individual, including each Potential Winner, agrees that their name, resident city, and/or their likenesses may be disclosed to and used by the news media, in lists of Prize winners (name and city only) to be published on the SCWA or SCWA website, and may otherwise be used by SCWA for publicity purposes, without further compensation, unless prohibited by applicable law.
CANCELLATION
SCWA reserves the right to cancel this Raffle at any time, at its discretion. If for any reason the Raffle is canceled, SCWA must reimburse the purchaser of each Raffle ticket, in the amount of the Raffle ticket purchased, within ninety (90) days of the Raffle cancellation date.

MISCELLANEOUS
If any provision or part of these Official Rules is found by a court of competent jurisdiction to be totally or partially invalid, illegal or unenforceable, then the provision will: (i) be deemed to be modified or restricted to the extent and in the manner necessary to make it valid, legal or enforceable, or; (ii) if unable to be so modified or restricted, it will be excised from these Official Rules without affecting any other provision of these Official Rules, which will be enforced to the maximum extent provided by law as if the modified or restricted provision was originally included or as if the excised provision was originally excluded.
These Official Rules and the Paperwork constitutes the entire agreement and supersedes all prior agreements and understandings, oral and written, between each individual participating in this Raffle, including each Potential Winner, and SCWA with respect to this Raffle.
